Slightly modified version of paper 1:
Legal categories and ontology
This paper will
discuss the notion of category in law and in the specific critically discuss
two (personae and res) of the three
basic legal categories of Roman law: personae,
res, actiones challenged by modern scientific developments and in light of
classical ontological conceptualizations and classifications of nature. It will
not intend to provide answers but only to frame the problem in its historical
and philosophical dimension and explore the relevance of the methodological
approach for legal theory and the notion of legal personhood.
